Is My Will Legal?

It’s not good enough only to have a will.

A court will also require:

• Capacity
  A testator must have a sound mind. In most states, you must either be 18 years old or be a member of the armed forces.
  

• Free Will
  You must be free of duress and undue influence.
  

• Witnesses
  Most states require you to sign your will in front of at least two disinterested witnesses.
  

• Intent
  You must intend to make this your last will and testament. You must understand what you have and what you intend to give.
