Parent Relocation
Laws and requirements for relocating parents vary by state.
The laws of the state in which you were divorced or, if unmarried, where your child lives will apply.
If you have an existing parenting plan or visitation order, the requirements for relocation may be contained in the order along with any travel restrictions.
In most states, you are required to notify the other parent in writing of your intent to relocate with the child and give the other parent an opportunity to oppose the relocation in court.
If you desire to relocate with your child and the other parent opposes the move, a court will consider several factors in determining whether or not to allow the child to relocate:
How much time each parent spends with the child
Purpose of the relocation
Any prior agreements between the parties
Impact of move on the child
Other parent's ability to maintain a relationship with the child
Quality of life, schools and opportunities available in the desired location versus that currently available
Child's preference
